What is a consumer proposal in Markham?

A consumer proposal is a federally regulated, legally binding agreement to repay a portion of what you owe. It’s filed through a Licensed Insolvency Trustee (LIT) under the Bankruptcy and Insolvency Act, and it can reduce your unsecured debt by up to 80%.

Unlike bankruptcy, you keep your home, car, and other assets. Unlike debt consolidation, there’s no new loan to take on and no minimum credit score required. You make one fixed monthly payment, interest-free, for up to five years.

It applies to most unsecured debts: credit cards, payday loans, personal loans, lines of credit, CRA tax debt, and certain student loans. Once filed, all collection calls, interest charges, and wage garnishments stop.

Is a consumer proposal right for you in Markham?

You may qualify for a consumer proposal in Markham if:

  •   You owe between $1,000 and $250,000 in unsecured debt (excluding your mortgage)
  •   You are a Canadian resident or own property in Canada
  •   You are an individual (not a corporation)
  •   You are at least 18 years old
  •   You cannot fully repay your debts as they fall due, but you can afford some monthly payment

If you’re not sure whether you qualify, our Markham team will assess your situation at no cost.

What are the benefits of a consumer proposal in Markham?

Consumer Proposals in Markham are a practical way to get out of debt while keeping your financial stability. Here’s how this government-regulated debt relief solution can help you take back financial control:

  • Reduce your debt by up to 80%. Creditors often accept significantly less than the full balance owed, helping you settle debt faster.
  • Stop collection calls and wage garnishments immediately. Legal protection begins the moment your proposal is filed with a Licensed Insolvency Trustee.
  • Keep your home, car, and assets. Unlike bankruptcy, a consumer proposal doesn’t require surrendering your property.
  • Pay 0% interest. All interest charges are frozen once the proposal is filed, so every payment reduces your principal.
  • One affordable monthly payment based on what you can realistically afford, spread over up to five years.
  • No credit check required to qualify. Eligibility is based on your debt situation, not your credit score.
  • Over 98% acceptance rate. Consumer proposals are a proven, high-success debt solution trusted across Ontario.
  • Government-regulated and legally binding. Your proposal is filed under the Bankruptcy and Insolvency Act, giving you full legal protection.

What types of debt are covered by consumer proposals in Markham?

A consumer proposal lets you roll most unsecured debts into a single, affordable monthly payment. If any of the following are keeping you up at night, a consumer proposal could be the fresh start you need.

  • Credit card debt – Get out from under high-interest balances across multiple cards
  • Payday loans and wage garnishments – Break the borrowing cycle and protect your paycheque
  • Personal loans and lines of credit – Combine what you owe to banks or private lenders into one payment
  • CRA tax debt – Settle income tax arrears, GST/HST owing, and CERB overpayments
  • Student loan debt – Eligible once seven or more years have passed since you finished school
  • Medical bills – Address lingering healthcare costs where applicable
  • Utility arrears – Include unpaid hydro, gas, or other utility balances

Your mortgage and car loan are secured debts, so they won’t be part of the proposal. The good news? Filing gives you the breathing room to stay current on those payments and hold onto what matters most.

Markham consumer proposal FAQs

Can I include CRA tax debt in a consumer proposal in Markham?

Generally, yes. CRA tax debt can be rolled into a consumer proposal alongside things like credit cards and lines of credit.

For proposal purposes, the CRA counts as an unsecured creditor, bundled with your other debts and given a vote like any other lender. This matters because tax debt grows fast through interest and penalties, and the CRA can garnish your paycheque or freeze your bank account without going to court first. A proposal stops that immediately.

Eligible amounts usually include personal income tax, GST/HST you owe personally, and CPP/EI overpayments. Payroll deductions or GST/HST a business collected in trust are treated differently, since they aren’t your own debt.

Does a consumer proposal affect your credit rating in Markham?

It does, though the effect is more limited and temporary than most people assume and considerably milder than a bankruptcy.

During the proposal, your file is marked with an “R7” rating, which simply flags that you’re repaying debts through a formal arrangement. Bankruptcy carries an “R9” instead, the worst possible rating, which can linger on your file for as long as 7 years.

The R7 flag disappears 3 years after your last payment, no matter the length of your proposal. Scores often take a hit before filing (usually from missed payments), but plenty of Markham residents find their credit starts climbing again once payments are steady and creditors stop calling.

How do I do a consumer proposal in Markham?

Only a Licensed Insolvency Trustee can legally file one for you—it can’t be done independently or through a private debt company. The typical steps look like this:

  1. Meet with an LIT for a free assessment.
  2. They evaluate your debts, income, and expenses to see if a proposal fits.
  3. A formal proposal is drafted, offering partial repayment over up to 5 years.
  4. It’s filed with the Office of the Superintendent of Bankruptcy, instantly halting calls and garnishments.
  5. Creditors vote within 45 days; acceptance is the norm.
  6. You pay one fixed monthly amount, which the trustee forwards to creditors.
  7. Two credit counselling sessions are required.
  8. Your final payment clears the included debts for good.

How much does a consultation with a LIT cost in Markham?

Meeting with a Licensed Insolvency Trustee for the first time costs nothing, and you’re under no pressure to commit.

In this initial session, the trustee reviews your debt load, income, and assets, lays out every available option (consumer proposal, debt management plan, bankruptcy, or even just a budgeting fix), and gives you a fair estimate of potential monthly payments.

Because LITs answer to federal regulators, they must present all your choices fairly rather than steering you toward one. If you come across anyone charging money upfront just to “review” your debt, or rushing you toward a decision, be cautious—the Government of Canada warns against unlicensed advisors billing for guidance; a real trustee provides free of charge.

How much does a consumer proposal cost in Markham?

Filing a consumer proposal doesn’t come with a big upfront bill. Instead, the expense is folded into the monthly payments you’re already making.

Your payment is worked out using your income, necessary living costs, family size, and any assets that could otherwise be at risk in a bankruptcy. The trustee’s compensation, which is set by legislation rather than open to negotiation, comes out of that same payment—there’s no add-on invoice.

Drafting, filing, and the creditor vote itself don’t cost extra, and the required credit counselling sessions are bundled in as well.
